14 calendar days from the date the determination was mailed or sent electronically (the date of service)

- How to file
- Appeal in writing by email to appealsmail@labor.idaho.gov, by fax to 208-334-6440, or by mail. A mailed appeal counts as filed on the postmark date; a faxed or emailed appeal counts on the date IDOL receives it (Mountain time).

Appeal to the Idaho Supreme Court
- Deadline
42 calendar days from the filing stamp date on the Industrial Commission's decision
- What to know
- You can appeal the Industrial Commission's decision to the Idaho Supreme Court by filing a notice of appeal with the Industrial Commission within 42 days. A timely motion for reconsideration (within 20 days of the Commission's decision) restarts the 42 days from the decision on that motion.
Law: Idaho Code 72-1368(7), (9); Idaho Appellate Rule 14(a)
Every state must give a fair hearing before an impartial tribunal to anyone whose claim is denied.
Law: 42 U.S.C. 503(a)(3) (Social Security Act sec. 303(a)(3))
Appeal deadline calculator
Pick the appeal and enter the date it runs from. We add the days from the state's rule to that date.
Appeal request letter
Fill in the boxes and get a letter you can print or send. You write the reasons in your own words. The letter is in English because the agency works in English.
Hearing preparation checklist
Logistics and rights from your state's hearing information, plus your own list of witnesses and documents.
The hearing
- Format
- Hearings are held by telephone before an appeals examiner. IDOL mails a Notice of Telephone Hearing; if you did not get it, call the Appeals Bureau at 208-332-3572 right away.
- Documents and witnesses
- The appeals examiner decides based on the evidence, witness testimony and the rules. You cannot add information after the hearing unless the examiner leaves the record open or gives instructions.
- Subpoena
- Ask the appeals examiner to issue a subpoena for a witness whose evidence is needed; the examiner must issue it unless the request is unreasonable.
- Representation
- Claimants do not need a lawyer. If you hire one, you pay the fees; there is no way to recover them in Idaho unemployment cases.
- If you miss it
- If you missed the hearing or have new evidence, file a signed written request to reopen with the Appeals Bureau (not the Industrial Commission) within 10 days of the mailing date on the decision, by email, fax or mail. If it is denied, you have 14 days from that order to appeal to the Industrial Commission.
Law: Idaho Code 72-1368(6)
Overpayments and waivers
An overpayment means you were paid benefits you were not entitled to. IDOL notifies you by mail, and you must repay it before you can get more benefits. If IDOL finds you made a false statement or did not report a material fact, it adds a penalty of 25% for the first finding, 50% for the second and 100% for later ones, and you can be disqualified for 52 weeks or more.
- Appeal within
- 14 days from the date of service (mailing) of the overpayment determination
- Waiver
- The state can waive some overpayments.
- The standard
- IDOL may waive a non-fraud overpayment if it was paid only because of a department error, or only because an employer misreported your base-period wages, and you could not reasonably have been expected to recognize the error.
- How to ask
- Ask for a waiver within 14 days of being told about the overpayment. Follow the instructions on the Determination of Overpayment to get a Determination of Waiver.
- How the state collects
- IDOL keeps your future weekly benefits to pay the balance. If you do not repay, it may garnish your or your spouse's wages, seize bank accounts, take state and federal tax refunds (the federal refund only for an overpayment caused by fraud or unreported earnings, after a notice giving you at least 60 days to respond), and file a lien on your property. Interest is charged. You can ask for a payment plan at 1-800-672-5627 or 208-332-3573.
Law: Idaho Code 72-1369; Idaho Code 72-1369(5)
What federal law adds on overpayments
- Whether an overpayment can be waived, and how to ask, depends on your state's law. See your state's page.
- Your federal tax refund can be taken to pay a past-due state unemployment overpayment caused by fraud or by not reporting your earnings, once it is final under state law. Before this happens, the state must notify you and give you at least 60 days to show that the debt is not owed or not legally enforceable.
Law: 26 U.S.C. 6402(f)
- For fraud overpayments, the state must add a penalty of at least 15 percent.
Law: 42 U.S.C. 503(a)(11)
