Appeal deadline calculator
Pick the appeal and enter the date it runs from. We add the days from the state's rule to that date.
Appeal request letter
Fill in the boxes and get a letter you can print or send. You write the reasons in your own words. The letter is in English because the agency works in English.
Hearing preparation checklist
Logistics and rights from your state's hearing information, plus your own list of witnesses and documents.
The hearing
- Format
- Appeal hearings are mainly held by Zoom (telephone hearings are also used). Join at the time on your hearing notice. Hearings are free and you do not need a lawyer.
- Documents and witnesses
- Use the Telephone Information Return Form to give your phone number, your witnesses' names and phone numbers, and the number of pages of documents you are sending. If you send documents to the Tribunal, also send copies to the employer and other parties and complete the certificate of service.
- Subpoena
- Use the Claimant's Request for Witness Subpoena or Request for Document Subpoena forms on the Appeal Tribunal's Claimant Forms page.
- Interpreter
- Mark the interpreter box on the Telephone Information Return Form and give the language for you or your witnesses. A separate form is available to request an interpreter for hearing-impaired parties.
- Representation
- You may be represented by a lawyer or other representative at your own cost.
- If you miss it
- To postpone a hearing, send the Claimant's Request for Continuance at least five days before the hearing; in emergencies the Tribunal may consider later requests. Hearings are scheduled Monday to Friday, 8:30 a.m. to 3:30 p.m. Central time.
Law: Neb. Rev. Stat. sec. 48-634
Overpayments and waivers
If you got benefits you were not entitled to, you must repay them. NDOL can collect by taking future benefits, by civil action (without interest), from your state income tax refund, from gambling winnings, and from your federal tax refund for certain debts. If an overpayment was not your fault and taking it from future benefits would defeat the purpose of the law or be against equity and good conscience, NDOL may not take it from your future benefits.
- Appeal within
- 20 days from the date the determination was mailed
- Waiver
- Not available in our data for regular benefits.
- How the state collects
- Offset against future benefits (except as above), civil action without interest, state income tax refund setoff, gambling winnings setoff, and federal tax refund offset after a 60-day notice.
Law: Neb. Rev. Stat. sec. 48-665; Neb. Rev. Stat. sec. 48-665(1)
What federal law adds on overpayments
- Whether an overpayment can be waived, and how to ask, depends on your state's law. See your state's page.
- Your federal tax refund can be taken to pay a past-due state unemployment overpayment caused by fraud or by not reporting your earnings, once it is final under state law. Before this happens, the state must notify you and give you at least 60 days to show that the debt is not owed or not legally enforceable.
Law: 26 U.S.C. 6402(f)
- For fraud overpayments, the state must add a penalty of at least 15 percent.
Law: 42 U.S.C. 503(a)(11)
