Petition for review in district court

Deadline

30 calendar days from the day the Board of Review's decision is mailed

What to know
You can ask the district court of the county where you live (Oklahoma County if you live out of state) to review the Board of Review's decision. File a petition for review within 30 days. It must name the Board of Review, OESC and the other parties, and state the grounds. The court decides questions of law. This deadline cannot be waived.

Law: 40 O.S. secs. 2-610, 2-614

Every state must give a fair hearing before an impartial tribunal to anyone whose claim is denied.

Law: 42 U.S.C. 503(a)(3) (Social Security Act sec. 303(a)(3))

The hearing

Format
Usually by telephone (some in person). You must register by 2:00 p.m. the business day before the hearing (the Friday before for a Monday hearing) online at ok.c2tinc.com/register or by calling the Appeal Tribunal. If you do not register, you cannot take part and the appeal may be dismissed. The hearing officer calls the number you registered.
Documents and witnesses
Send copies of all your documents to the Appeal Tribunal at least five days before the hearing so copies can go to the other party. Each party may submit at most 50 pages. Audio, video and images must be in standard formats (such as MP4, MP3, JPG or PDF).
Subpoena
Send a written request to the Appeal Tribunal at least five days before the hearing with the case number, hearing date and place, the name and mailing address of the witness or record holder, and what the testimony or records are and why they are needed.
Interpreter
Tell the Appeal Tribunal right away if you need an interpreter, and one will be provided.
Representation
You may appear with or without a representative. If you want a lawyer but cannot find or afford one, contact a local bar association or legal aid. A lawyer's fee cannot be more than 20% of the maximum benefit amount awarded.
If you miss it
If you miss the hearing, the case is decided on the record. You can ask to reopen within 10 calendar days after the decision is mailed, giving the reason you did not appear. To postpone, ask in writing at least four days before the hearing and show good cause.

Law: Okla. Admin. Code 240:10-13

Overpayments and waivers

Oklahoma has three kinds of overpayment. Fraud: you repay the amount plus a 25% penalty and 1% interest a month. Claimant error (an honest mistake): you repay the amount plus 1% interest a month. Administrative (an OESC or employer error, or a decision reversed on appeal): it is only taken from future benefits in your current and next benefit year, with no interest, though you may repay it voluntarily.

Appeal
The mailing date of the Notice of Overpayment Determination. You have 20 days for a fraud or claimant-error overpayment, and 10 days for an administrative overpayment. If the overpayment comes from a determination, appeal both.
Fraud penalty
25% added when the overpayment is fraud
Waiver
Not available in our data for regular benefits.
How the state collects
OESC deducts fraud and claimant-error overpayments from any future benefits and can collect them with interest; state law also allows a warrant of levy and lien.

Law: 40 O.S. secs. 2-613, 2-616, 2-617; 40 O.S. secs. 2-613, 2-615

What federal law adds on overpayments

  • Whether an overpayment can be waived, and how to ask, depends on your state's law. See your state's page.
  • Your federal tax refund can be taken to pay a past-due state unemployment overpayment caused by fraud or by not reporting your earnings, once it is final under state law. Before this happens, the state must notify you and give you at least 60 days to show that the debt is not owed or not legally enforceable.

    Law: 26 U.S.C. 6402(f)

  • For fraud overpayments, the state must add a penalty of at least 15 percent.

    Law: 42 U.S.C. 503(a)(11)
